Legal Consultant on the Renewal of the Host Country Agreement

Between the Regional Secretariat of CTI-CFF and Government of Indonesia

 

 

I.    Rationale

The Coral Triangle Initiative on Coral Reefs, Fisheries and Food Security (CTI-CFF) is a multilateral partnership of six countries (Indonesia, Malaysia, Philippines, Papua New Guinea, Solomon Islands, Timor-Leste) working together to sustain extraordinary marine and coastal resources by addressing crucial issues such as food security, climate change and marine biodiversity.

 

In 2015, the Regional Secretariat of the CTI-CFF established in 28 October 2011 by member countries, and the Government of Indonesia has entered into an Agreement via the Host Country Agreement (HCA) which was signed on 1st December 2015 and will expire on 1st December 2020. The HCA was developed to address issues on the juridical personality of the Regional Secretariat, the responsibilities of both of the Government of Indonesia and the Regional Secretariat and other relevant matters.

 

Currently, member countries of CTI-CFF are reviewing the draft HCA for renewal the agreement before it is presented to the Government of Indonesia by the Regional Secretariat. Further, an Exchange of Note had been provided by the Regional Secretariat to the Government of Indonesia through the Ministry of Marine Affairs and Fisheries requesting for the extension of the current HCA for six (6) months or until 1st June 2021 or until the new HCA is signed as recommended by the Internal Resource Committee of the Coral Triangle Initiative on Coral Reefs, Fisheries and Food Security (CTI-CFF) to be able to carry out more effectively the review of the renewal of the draft HCA. 

 

II.      Objective and Scope of the Consultancy

 

The overall objective of the Consultancy is to review and to provide recommendations including to provide the technical support to the management of the Regional Secretariat by providing sound, technical and legal advice regarding the Host Country Agreement during meetings with the representatives of the Government of Indonesia conducted via online.

 

The following deliverables in English must be met:

·       Review of and technical input/advise/recommendations on the final draft of the Host Country Agreement

·       Presence/representation together with the management of Regional Secretariat during three (3) online meetings on Host Country Agreement to give technical input/advise/recommendation to the management of the Regional Secretariat

 

III. Consultancy Terms 

 

The contract will be short-term and shall have the following timelines:

 

·       Review of final draft of HCA with inputs/suggestions/advise/recommendations: 2 days

·       Presence/representation during actual meetings of the HCA: 3 meetings

 

The engagement will be undertaken remotely/virtually. The Legal Consultant will report directly to the Deputy Executive Director of Corporate Services and Executive Director of the CTI-CFF Regional Secretariat,

 

The consultancy agreement for this assignment will be based on a maximum number of working days service rendered. Payments will be based on actual hours worked with timesheets.

 

 

iv. Qualification Essentials

· Legal Partners must have Advanced Degree in Law with a focus in international law, HCAs

· Experience in handling the case of international organizations, government, multinational companies

· At least 10 years of experience in law practice at an international level

· Fluency in English

·       Qualifications, background and experience of staff to be assigned to the activity

·       Prior experience in handling international organizations/international governmental organizations particularly in reviewing and working on Host Country Agreement

·       List/sample of clients from international organizations and services provided

 

B.    Pricing

Please provide a detailed budget for the proposal with a breakdown of costs by separate line items. The hourly rate of those assigned to the project should be included. (Calculation of the financial proposals is not more than 5 (five) working days, 2 days for writing the recommendations and 3 days for presence in the meeting)

 

C.     Evaluation

All proposals will be reviewed, evaluated and rated based on the following:
